Acceptance of Terms

By accessing or using Scribbly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years of age to use the Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

Description of Service

Scribbly is a mobile-first web application designed to help parents and caregivers preserve children's artwork digitally. The Service enables users to:

• Capture and store digital images of children's artwork
• Organize artwork in personalized digital galleries
• Enhance artwork images using AI-powered cleanup tools
• Create and order custom printed photobooks (books)
• Add stories, dates, and context to each artwork

Account Registration

To use the Service, you must create an account using email/password, Google sign-in, or Apple sign-in. By registering, you agree to:

• Provide accurate and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify Scribbly immediately of any unauthorized access or security breach

Pricing & Payments

Scribbly operates on a pay-as-you-go model. The free service includes:

• Unlimited children profiles
• Unlimited artwork storage
• AI-powered image cleanup and enhancement
• Purchase gift vouchers for photobook orders

Prepayment: Photobook orders and gift vouchers are paid upfront at the time of purchase. Credits can be applied toward future orders.

Refunds: Due to the personalized nature of photobooks, refunds are only issued for defective products or shipping damage. Gift voucher purchases are non-refundable.

Photobook Orders

Photobooks are custom, personalized products created according to your specifications. Please review the following policies:

• No Returns: Due to the personalized nature of photobooks, we cannot accept returns or exchanges except in cases of manufacturing defects or damage during shipping.
• Review Before Ordering: You are responsible for reviewing and approving your photobook design, including all artwork selections, layouts, and text, before placing an order.
• Production: Production begins immediately after order confirmation and payment. Orders cannot be modified or cancelled once production has started.
• Defective Products: If you receive a defective product, please contact our support team at info@scribbly.art within 14 days of delivery with photos documenting the defect. We will arrange for a replacement or refund at our discretion.

Gift Vouchers

Scribbly gift vouchers are subject to the following terms:

• Available Values: Gift vouchers are available in values from $25 to $500.
• Validity: Gift vouchers are valid for 18 months from the date of purchase.
• Non-Refundable: Gift vouchers are non-refundable and cannot be exchanged for cash.
• Non-Transferable: Gift vouchers cannot be transferred for monetary value.
• Usage: Gift vouchers can be applied toward photobook orders and other Scribbly services.

Intellectual Property

Your Content: You retain all ownership rights to the artwork images and content you upload to the Service. Scribbly does not claim ownership of your content.

License to Scribbly: By uploading content to the Service, you grant Scribbly a limited, non-exclusive, worldwide license to process, store, display, reproduce, and transmit your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.

Scribbly's Intellectual Property: The Service, including its design, features, functionality, software, trademarks, logos, and all other intellectual property, is owned by Scribbly and is protected by Swiss and international copyright, trademark, and other intellectual property laws.

User Conduct

You agree not to use the Service to:

• Upload, share, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
• Upload content that infringes upon the intellectual property rights of others
• Attempt to access other users' accounts or personal data
• Interfere with or disrupt the Service or servers
• Use the Service for unauthorized commercial purposes
• Reverse engineer, decompile, or attempt to extract the source code of the Service

Shipping & Delivery

Photobook orders are fulfilled by our print partner, Gelato. Please note the following:

• Shipping Times: Delivery times vary by location. Typical delivery is 7-14 business days from order confirmation, though this may vary based on destination and shipping method selected.
• Shipping Address: You are responsible for providing an accurate and complete shipping address. Scribbly is not liable for orders lost or delayed due to incorrect address information.
• International Orders: For orders shipped outside Switzerland, the buyer is responsible for all applicable customs duties, import taxes, and fees. These charges are not included in the product or shipping price.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Scribbly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Service.
• Scribbly's total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the total amount you have paid to Scribbly in the twelve (12) months preceding the claim.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any guarantee that the Service will be uninterrupted, timely, secure, or error-free
• Any guarantee regarding the accuracy or reliability of information obtained through the Service

Termination

By You: You may terminate your account at any time by deleting your account through the Service settings. Upon termination, your right to use the Service will cease immediately, and your data may be deleted.

By Scribbly: Scribbly reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, including for violations of these Terms. We will make reasonable efforts to notify you of such termination.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

Changes to Terms

Scribbly reserves the right to modify these Terms at any time. We will notify you of any material changes by sending an email to the address associated with your account and/or by posting a notice within the Service.

Your continued use of the Service after such changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
